These Terms & Conditions ("Terms") govern your access to and use of the Trainer & Assessor application and website (the "Service"), operated by RinZin IT ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is — and what it is not
The Service provides AI-assisted tools to help qualified trainers and assessors working in the Australian vocational education and training (VET) sector — for example, assisting with the review of student assessment evidence against a marking guide, and (as further modules are released) trainer-matrix validation and professional-development / industry-currency tracking.
The Service only assists you. It does not make decisions and its outputs are not authoritative. Every output the Service produces — including findings, suggested outcomes, quality ratings, summaries and any generated document — is a draft aid for your consideration only. In particular, an output of the Service is not:
- a completed, valid or compliant assessment or assessment judgement;
- evidence that a student is competent or not yet competent;
- a substitute for the professional judgement of a qualified trainer or assessor;
- a substitute for your RTO's assessment system, validation, moderation, or your obligations under the Standards for RTOs, the National Vocational Education and Training Regulator Act, ESOS/CRICOS, or any requirement of ASQA, TEQSA or another regulator; or
- legal, compliance, or professional advice.
You, the qualified trainer or assessor, remain solely and fully responsible for reviewing, verifying, amending and signing off every outcome, and for all assessment, competency and compliance decisions. You must not represent any output of the Service as a legitimate or independent assessment outcome, and you must not rely on it without your own review.
2. Who may use the Service
The Service is intended for use by trainers, assessors and RTO staff who hold the relevant vocational competencies and credentials to perform the work the Service assists with. You confirm that you are authorised to use the Service in your role and that you are at least 18 years old.
3. Your responsibilities
- Apply your own professional judgement to every output and independently verify it before acting on or finalising it.
- Ensure your use complies with your RTO's policies and procedures and with all applicable laws, standards and regulatory requirements.
- Only upload material you are authorised to upload, and ensure you have the necessary rights and consents for any student or third-party information it contains (see our Privacy Policy).
- Keep your login credentials secure and not share your account.
4. AI outputs — accuracy and limitations
The Service uses artificial intelligence. AI can be incomplete, inconsistent or wrong, and can produce plausible-sounding but incorrect content ("hallucinations"). We do not warrant that any output is accurate, complete, current or fit for a particular purpose. Outputs may vary between runs. You must treat every output as unverified until you have checked it yourself.
5. Subscriptions, credits and payment
- Access to modules is provided under a monthly subscription plan. Per-run AI usage, and any file-storage usage above your included allowance, are charged from your prepaid wallet balance.
- You can switch plans at any time. On a change we credit the unused portion of your current plan and start the new plan from the day of the change (pro-rata), through our payment processor.
- Payments are processed by Stripe. By subscribing or topping up you also agree to Stripe's terms. We do not store your full card details.
- Prices are in Australian dollars and may be exclusive of GST unless stated. We may change prices on reasonable notice; changes do not affect the current paid period.
- Except where required by the Australian Consumer Law, subscription fees and consumed AI usage are non-refundable. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
6. Acceptable use
You must not misuse the Service, including by attempting to breach security or access controls, uploading unlawful or malicious content, reverse-engineering the Service, using it to build a competing product, or using it in any way that could bring the Service or other users into disrepute or breach a regulator's requirements.
7. Intellectual property
We and our licensors own the Service and all associated intellectual property. You retain ownership of the content you upload. You grant us a limited licence to process your content solely to provide the Service to you. You may use the outputs for your own legitimate professional purposes, subject to these Terms.
8. Privacy and data
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. You are responsible for the lawfulness of any personal information (including student information) you upload.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of, or reliance on, the Service or its outputs — including any assessment, competency, compliance, audit or regulatory outcome — and our total liability to you is limited to the fees you paid us in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under the Australian Consumer Law.
10. Indemnity
You indemnify us against claims, losses and costs arising from your breach of these Terms, your misuse of the Service, your reliance on an output without your own review, or your upload of content you were not authorised to upload.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where reasonably necessary to protect the Service or other users. On termination your right to use the Service ends; provisions that by their nature should survive will survive.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and update the "last updated" date. Continued use after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Australia and the State or Territory in which we are established, and you submit to the non-exclusive jurisdiction of the courts there.
